Welcome to The Daily Christ. These Terms of Service ("Terms") govern your access to and use of the website thedailychrist.com (the "Site") and any purchases made through it. By accessing the Site or placing an order, you agree to be bound by these Terms.
The Site is operated by Noire Eagle LLC ("we," "us," "our"), a Wyoming limited liability company with its principal place of business at 2106 House Ave, Suite 620, Cheyenne, WY 82001, United States.
PLEASE READ THESE TERMS CAREFULLY. They contain important information about your legal rights, remedies, and obligations, including a binding arbitration agreement and a class action waiver (see Section 18), which affect how disputes are resolved.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement and that the information you provide is accurate and complete.
2. Products
We sell physical books and related products. We make every effort to display our products accurately, but colors, finishes, and details may vary slightly from what appears on your screen due to display settings and printing variation.
We reserve the right to limit quantities, refuse orders, or discontinue any product at any time. All products are offered subject to availability.
3. Orders & Acceptance
Placing an order constitutes an offer to purchase. Your order is only accepted once we send a confirmation email and the order has been processed for shipment. We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, pricing errors, or stock shortages.
If we cancel an order after payment has been taken, you will receive a full refund.
4. Pricing & Payment
All prices are listed in US dollars (USD) unless stated otherwise and are exclusive of any applicable taxes, duties, or shipping fees, which are calculated at checkout.
Payment is processed through secure third-party payment providers. By submitting payment information, you authorize us to charge the full order amount, including shipping and applicable taxes.
We reserve the right to correct pricing errors at any time, including after an order has been placed. In such cases, you will be notified and given the option to confirm or cancel the order at the corrected price.
5. Shipping & Delivery
Shipping times and costs are displayed at checkout. Delivery estimates are provided in good faith but are not guaranteed. Risk of loss and title for products pass to you upon delivery to the carrier.
You are responsible for providing an accurate shipping address. We are not liable for orders that are lost or delayed due to incorrect address information provided by the customer.
International customers are responsible for any import duties, customs fees, or local taxes imposed by their country.
6. Returns & Refunds
Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
EU and UK consumers retain their statutory right of withdrawal under applicable consumer protection law, which operates in addition to our standard refund policy.
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, book content, product designs, and the "The Daily Christ" name and brand — is the property of Noire Eagle LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission. Purchase of a physical product does not transfer any intellectual property rights in the underlying content.
8. User Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any part of the Site, our systems, or other users' accounts
- Use any automated means (bots, scrapers, crawlers) to access the Site without our written consent
- Submit false, misleading, or fraudulent information when placing an order
- Interfere with the security or proper functioning of the Site
9. Disclaimers
The Site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by applicable consumer protection law.
The Daily Christ offers content of a religious and inspirational nature. Nothing on the Site is intended as medical, psychological, financial, legal, or professional advice. You should consult a qualified professional for advice specific to your situation.
10. Limitation of Liability
To the fullest extent permitted by law, Noire Eagle LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product purchased through it.
Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including statutory rights of EU and UK consumers.
11. Indemnification
You agree to indemnify and hold harmless Noire Eagle LLC, its officers, members, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the most recent changes were made. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
For material changes, we will make reasonable efforts to notify you (for example, via email or a notice on the Site).
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles.
Subject to the binding arbitration agreement in Section 18, any dispute that is not subject to arbitration shall be resolved in the state or federal courts located in Wyoming, and you consent to the exclusive jurisdiction of those courts.
This clause does not deprive consumers resident in the European Union or United Kingdom of the protection of mandatory consumer law in their country of residence, nor of the right to bring proceedings in their local courts where such rights apply.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and Noire Eagle LLC regarding your use of the Site and supersede any prior agreements.
17. Force Majeure
We shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, pandemic, labor disputes, internet or utility failures, or supply chain disruptions.
18. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
18.1 Agreement to Arbitrate
You and Noire Eagle LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased through the Site (a "Dispute") shall be resolved exclusively through binding individual arbitration, except as set out below.
This includes claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, whether arising before or after the effective date of these Terms.
18.2 Exceptions
The following are not subject to arbitration:
- Small claims court actions, provided the claim qualifies and remains in that court
- Claims for injunctive or equitable relief to protect intellectual property
- Disputes that, by applicable law, cannot be subject to mandatory arbitration
18.3 Arbitration Procedure
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be Cheyenne, Wyoming, but in-person hearings are not required and may be conducted by telephone or video conference for claims under $25,000.
The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
18.4 Class Action Waiver
YOU AND NOIRE EAGLE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
If this class action waiver is found to be unenforceable, then the entirety of this Section 18 shall be null and void, and the Dispute shall proceed in court under Section 14.
18.5 30-Day Right to Opt Out
You have the right to opt out of this arbitration agreement by sending written notice to support@thedailychrist.com within 30 days of first accepting these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.
18.6 EU/UK Consumer Rights
This arbitration clause does not apply to consumers resident in the European Union or United Kingdom to the extent that mandatory consumer protection law in their country of residence grants them the right to bring proceedings in local courts.
18.7 Survival
This Section 18 survives termination of these Terms and your relationship with Noire Eagle LLC.
